To Trade in Real Estate in Vietnam

Conditions for organizations and individuals to trade in real estate:

– Organizations, individual trade in real estate must establish enterprises or cooperatives, must have legal capital and register business in accordance with the law. (Today it is VND 6 billions)

– Organizations, individuals provide real estate services must establish enterprises or cooperatives, register business of real estate services in accordance with the law.

– Organizations, individuals trade in real estate broker service must have at least one people who have certificate in real estate brokerage; when trade in real estate valuation service must have at least two people who have certificate in real estate valuation; when trade in real estate transaction service must have at least two people who have certificate in real estate brokerage, if the transaction adds real estate valuation service must have at least two people who have certificate in real estate valuation.

– Personal trades in real estate broker services must register business in accordance with the law and have certificate in real estate brokerage.

The scope of real estate business activities of foreign organizations and individuals, Vietnamese who settled in abroad

Foreign organizations and individuals, Vietnamese who settled in abroad have permission to doing business in real estate and real estate services in the following scope:

– Investment in building house for sale, for lease.

– Investment in improving land and investment in infrastructure projects on leased land for leased land with infrastructure.

– Doing business in real estate services in accordance with paragraph 2 of Article 9 of this Law.

– Outside the scope above, based on the regulations of this Law, Land Law, Housing Law, Investment Law and other related legal documents, Government assigns other activities on real estate business of foreign organizations, individuals, Vietnamese who settled in abroad in accordance with economic – social conditions each period and timelines for international economic integration.
